Acceptance of Terms

By downloading, installing, or using IQ Trivia ("the App"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you ("User") and Prayag Gediya ("Developer", "we", "us").

The App is distributed through the Apple App Store and is subject to Apple's Standard End User License Agreement (EULA), which is incorporated by reference. In the event of any conflict, Apple's EULA takes precedence with respect to Apple's role as a third-party beneficiary.

License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial entertainment purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code
• Remove any copyright, trademark, or other proprietary notices
• Use the App for any unlawful or prohibited purpose
• Use automated tools, bots, or scripts to interact with the App
• Circumvent any technical measures used to protect the App or its content

Entertainment Purposes Only

Do not use the app's scores for any professional, medical, educational assessment, or employment screening purpose. For a clinically valid IQ assessment, consult a qualified psychologist or cognitive testing professional.

In-App Purchases

Remove Ads

The App offers a one-time in-app purchase ("Remove Ads") that permanently removes advertisements for the purchasing account. This purchase is:

• One-time and permanent — once purchased, ads are removed indefinitely for your Apple ID
• Non-transferable — tied to your Apple ID and cannot be transferred to another account
• Restorable — you can restore the purchase on any device signed in with the same Apple ID via the "Restore Purchases" button in Settings

Billing and Refunds

All purchases are processed by Apple through the App Store. Pricing is displayed in your local currency at the time of purchase. Refund requests must be submitted to Apple directly at reportaproblem.apple.com. We do not process refunds directly.

Price Changes

We reserve the right to change the price of in-app purchases at any time. Price changes do not affect purchases already made.

Virtual Items

XP points, ranks, streaks, and other in-app progression items are virtual goods with no monetary value. They cannot be exchanged for real money, transferred, or redeemed outside the App.

Intellectual Property

The App and all its content — including but not limited to the design, graphics, user interface, quiz questions, text, logos, and software — are owned by or licensed to Prayag Gediya and are protected by copyright, trademark, and other intellectual property laws.

You are granted no ownership rights in any content of the App. All rights not expressly granted are reserved.

Some trivia questions may be derived from public domain knowledge. General knowledge facts are not protected by copyright. Where applicable, we acknowledge any third-party content sources.

Advertising

The free version of the App displays advertisements provided by Google AdMob. Ads are shown between game sessions and on the home screen. Ads are never shown during active gameplay.

By using the free version of the App, you consent to the display of advertisements. Purchase Remove Ads to use the App without advertisements.

We are not responsible for the content of third-party advertisements. Ad content is determined by Google's advertising systems based on your device settings and, where consented, your advertising identifier.

Acceptable Use

You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• Attempt to gain unauthorised access to any portion of the App
• Introduce any virus, malware, or harmful code
• Attempt to manipulate scores, XP, or progression through unauthorised means
• Use the App in any way that could damage, disable, or impair the App or interfere with other users' enjoyment

Disclaimers and Limitation of Liability

App Provided "As Is"

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that quiz content is always accurate, complete, or current.

Limitation of Liability

To the maximum extent permitted by applicable law, Prayag Gediya shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising from your use of or inability to use the App.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for any in-app purchases in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Prayag Gediya from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the App in violation of these Terms.

Third-Party Services and Links

The App integrates third-party services including Firebase (Google LLC) and AdMob (Google LLC). Use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

The App may contain links to external websites or services. We do not endorse and are not responsible for the content or privacy practices of any third-party sites.

Apple: These Terms are between you and Prayag Gediya only, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App.

Termination

We reserve the right to terminate or suspend access to the App at any time, with or without cause, with or without notice. Upon termination, your licence to use the App ceases immediately.

You may terminate these Terms at any time by deleting the App from your device. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Removal of the App permanently deletes all locally stored progress. We are not liable for loss of data resulting from App deletion or device change.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may provide in-app notification.

Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, stop using the App.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at pdwap5@gmail.com. If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of India.

If you are a consumer in the EU, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

General Provisions

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
• Waiver: Failure to enforce any right under these Terms is not a waiver of that right.
• Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
• Language: These Terms are written in English. Any translated versions are for convenience only; the English version governs.
